"Is powering Pokémon to lv40 cheating?"

#PokemonGO: So, as I'm about to hit lv38, I am still unsure whether to do one of the known tricks to get my current maxed pokémon to lv40.  Also, with the gym rework coming in 1-2 weeks they might "fix" this so it might be either now or never. It would be nice to have an official word from Niantic about this topic.  Is this considering cheating?, since this can be so easily fixed, either by allowing to power up pokemon normally to lv40 or changing the server side pokemon level cap to 39. Edit: Is logging on two devices at the same time really against the TOS?
