"Northern District (SFO) California Ruling on the 2016 Class Suit vs Niantic - USD 1,000 for each plaintiff."
#PokemonGO: Summary:On November 2016, some homeowners in the USA filed a class-action lawsuit in the US because Pokemon Go encouraged people to trespass on their land. The case was brought to the Northern California Federal Court.Niantic has not accepted any blame or liability, and has appropriated $4m to settle the case. The Northern California Federal Court has released a ruling, which states that each of the Plaintiff will get USD 1,000 (instead of USD 2,500).There seems to be no clear direction on “virtual trespass” would affect and interact with property laws: something the judge noted does not have any clear precedent. The Settlement also discussed about Injuctive Relief. One of the provisions of the relief states that “for complaints properly received through Niantic’s website related to nuisance, trespass, or a request to remove a PokéStop or Gym (each a “POI”), Niantic will use commercially reasonable efforts (“CRE”) to resolve the complaints and communicate a resolution within no more than 15 (fifteen) days of wait time for the requestor, for 95% of cases each year”.Click here for the full details of the settlement. via /r/TheSilphRoad https://ift.tt/2PaMgFx
