Ban appeals do not yield any results. Thousands of emails and tweets to Niantic do not yield any results. What are we to do after pouring both our time and money into the game only for Niantic to erroneously suspend or terminate access to our accounts? Many redditors have gotten together and realized that many happened to play on an older verison of iOS (12) or a newer, beta version of iOS (15). Countless emails and tweets to Niantic have fallen on deaf ears. Niantic is adamant that their automated anti-cheat system is 100% perfect and accurate, which we know to not be true, based on them having to reverse strikes in 2019 and 2020 when their anti-cheat system striked against trainers using Xiaomi Redmi devices. Thank you for your time.Step 2: Filing a Complaint with the Better Business BureauYou may file a complaint with the BBB here. Do keep in mind that the BBB has no actual authority, and can only forward your grievance to Niantic on your behalf. Response from Niantic is not mandated by any legal or governmental sanctions, however, they do seem to respond to most BBB complaints (albeit not usually with the requested resolution).Step 3: ArbitrationAs per Niantic's Terms of Service, you agree to binding arbitration with Niantic Labs unless you manually opt-out within 30 days of agreeing to their ToS. The clause stipulates that arbitration will be handled by the American Arbitration Association. Niantic states that they will cover any fees relating to arbitration so long as your claim does not exceed $75,000 USD and that your claim is not found to have been frivolous or for the purpose of harassment. Thus, there is no risk to starting the arbitration process.To begin the arbitration process, you will need to send Niantic a written 'Demand for Arbitration' letter via snail mail. The letter must include:Brief description of complaint/grievanceYour full legal name & mailing addressNiantic's physical addressWhether you would like an in-person hearing, telephone hearing, or a document-only decision (no hearing)Desired resolution (In this case, reversal of false strike)Niantic's physical mailing address to send this demand letter to is:1 Ferry Building Suite 200,San Francisco, CA 94111You must also send a copy of a letter to the AAA or file your claim online here.
